Terms & Conditions
Please Read Very Carefully
We are not embarrassed to have a long list of requirements that we would ask our students and guests to stick too. That way we can hand on heart say – brownies honour that we have done everything that we can to make every occasion and class as enjoyable as possible for you, other students and our instructors that teach the sessions.
Interpretation:
In these Terms and Conditions ‘TFS’ shall mean The Fitness Studios and ‘PPF’ shall mean Pole Perfect Fitness.
(Sessions have been designed for adults that appear to be healthy)
1.0 – Instructions and Participation: (Content of each session: – Warm up / Main / Cool down including stretches) | ||
1.1 | If you are late and warm-up has started, you may not be allowed to join a TFS/PPF session for your safety. See 3.1 our Late Policy for further details. | |
1.2 | Your signed Screening Form & Informed Consent and Terms and Conditions must be received before you can participate in any classes and must be immediately updated if your circumstances change. | |
1.3 | TFS/PPF reserves the right to refuse entry to any class or ask to cease their participation if, in their personal opinion, any participant is a risk to themselves or others in the class. This may include (but is not limited to) failure to listen to or comply with the instructions and safety guidelines given, appearing to be under the influence of alcohol and/or drugs and/or the recent application of hand creams or body lotions that TFS/PPF deems unsafe. | |
1.4 | All activities will be explained and demonstrated. If you feel you have not understood any instruction you must notify the Instructor so that activities can be further explained and demonstrated until fully clear. | |
1.5 | TFS/PPF explicitly asks that you do not attempt any exercise at home that you have not been taught within sessions in the interests of your own safety. Failure to respect this request may result in PPF refusing entry and/or participation in future sessions. | |
1.6 | As outlined in the Screening Form, you must immediately stop and notify the Instructor if you feel pain or discomfort at any point during the session. Please note that a Therapist regularly on site and may be able to assist in preventing any further issues; if you would like to seek the assistance of our Sports Therapist at any time (subject to availability) please inform your Instructor. | |
1.7 | Please be aware that in our classes/sessions, there will be a need for physical contact by the instructor for safety in spotting, skill learning and correcting techniques. Your personal privacy will be considered at all times but not at the risk of your health and the ultimate safety of everyone else. | |
2.0 – Booking Classes/Sessions: | ||
2.1 | Places are reserved on a first-come, first-served basis, subject to availability and only confirmed upon receipt of payment in full and completed forms (Health Questions / Terms and Conditions / Informed Consent and Policies). | |
2.2 | You will not be refunded if TFS/PPF exercise their discretion and decides that it is unsafe for you to participate due to any of the reasons outlined in section 1 above and cannot allocate your space in any class/session to another participant. | |
2.3 | If you become injured or ill and unable to continue to attend TFS/PPF classes and/or sessions, a refund can only be given when supported by appropriate medical evidence according to the Cancellation Policy stated below at 3.2. | |
2.4 | Please keep in mind that your class/session payment may be forfeited if you are deemed unfit to attend any class/session due to having deliberately provided incorrect or misleading information in your Screening Form replies or to your Instructor. | |
2.5 | TFS and PPF reserve the right to adapt to the class timetable at any time; all classes are subject to change at any time. This is to allow but not be limited to extreme weather conditions, local area situations, students’ particular requirements and the like. It is your responsibility to keep your contact information up to date! | |
2.6 | If a class or course is cancelled by TFS/PPF, your class/sessions or courses will be rearranged. Where this is not possible, in such cases your booking account will be credited. We’ll try to give you as much notice as possible if a class or course needs to be rescheduled. | |
3.0 – Class/Session Cancellation & Late Policy: | ||
3.1 | Late Policy: If you are late and the warm-up has started, you may not be allowed to join in a TFS/PPF session for your own safety. A safe warm-up is essential to ensure that your muscles and joints are prepared for exercise in order to prevent/reduce the risk of injuries. Failure to attend before the warm-up has been completed may result in the full forfeiture of your class payment. | |
3.2 | Cancellation Policy: TFS/PPF reserve the right to exercise their discretion in exceptional circumstances; however, you may not be refunded monies paid in advance in respect of classes/sessions you have booked but fail to attend if less than 12 hours notice is given, save for in the event of illness or injury preventing you from participating in any fitness activities, supported by medical evidence. In such cases, your booking account will be credited with the pro-rata payment upon receiving the appropriate medical evidence. | |
3.3 | No Show Policy: If you fail to cancel a session within the cancellation period (known as Late Cancel) or contact us prior to the commencement of a session (Facebook Page / Email / Answerphone Message), you will be noted as a ‘No Show’ which forfeits any class credit/payment received and furthermore subject to a ‘No Show Charge’. This will be automatically added to your account, and payment will be made before any further access to sessions will be permitted. Online or Virtual sessions are exempt. All decisions are at the discretion of PPF and are final. | |
4.0 – Monthly Subscriptions: | ||
4.1 | All Subscriptions of TFS/PPF are strictly payable per calendar month on the 1st and are not transferrable or refundable. | |
4.2 | Notice Period: At the end of your contracted period, you are required to inform TFS/PPF by the 15th day of the Calendar Month of any changes to TFS / PPF Subscriptions; no changes can be made after this date until the following month, we accept no responsibility if you fail to inform us with the required notice (Once the Booking System has initiated the Subscription) and you will be required to fulfil terms of the Subscription. | |
4.2.1 | On Hold: TFS/PPF Subscriptions can only be placed on hold save for in the event of illness or injury preventing you from participating, supported by documentary evidence from your doctor and on receipt, which TFS/PPF will keep a copy on your file, if this is during the minimum term required this will therefore extend the minimum terms by the length of time placed on hold. | |
4.2.2 | TFS/PPF Subscriptions will not be prorated unless we do not meet a minimum of 10 TFS classes / 24 PPF classes per calendar month. If, in this event, we do not meet this minimum requirement, the next payment will be reduced by the prorated amount. It is deemed your choice to attend as much or as little as you wish; therefore, we do not accept responsibility for your usage. Subscriptions with a set numbered limit of classes/sessions or credits per calendar month will not be rolled over if not used within that calendar month unless an exception of 4.2.1 applies. | |
4.3 | Late Payment Charges: Subscription fees are strictly payable on the 1st of each month. TFS/PPF will not tolerate late payments and will pursue total costs. For every 7 days the payment is late, a fee of £10 Administration fee will be applied to the account. The account can be settled within the initial 7 days without charges or penalties. Any outstanding costs will incur additional charges to cover 1 x chase up call, 1 x chase up email, final notice letter and if necessary Debt Collection Agency/Legal fees by the 28th day of non payment, you will be 100% liable for all of these costs. You will not be permitted to book any classes/sessions or services until the account has been settled. Late Payment Charges also apply if 4.2 are breached. | |
5.0 – PAYG Block Bookings: | ||
5.1 | All Block Bookings of TFS/PPF are non-transferable; TFS and PPF PAYG Block Bookings will expire 8 weeks after 1st registration, unless otherwise stated. Additionally, unless rolled forward in the case of illness/injury preventing you from participating, supported by documentary evidence from your doctor and on receipt, which TFS/PPF will keep a copy on your file. In such cases, your booking account will be credited with the pro-rata payment on receipt of the appropriate medical evidence. | |
6.0 – Ad Hoc Events: (Ad Hoc Events including but not exhaustive to KSFL Packages/Specialist courses/Workshops/Master Classes/Photo Shoots) | ||
6.1 | Ad Hoc Events: Places for all Ad Hoc Events are non-refundable, save for in the event of illness or injury preventing you from participating, supported by documentary evidence from your doctor and if TFS/PPF are unable to allocate your space in any class/session to another participant. In such cases where your place can be filled by another participant, and on receipt of the appropriate medical evidence, your booking account will be credited. Nothing in this clause shall preclude you from obtaining a refund if TFS/PPF are in serious default of their obligations to you. Late Policy applies. | |
6.2 | KSFL Packages: Places for any KSFL packages/courses are strictly no refund under any circumstances once you receive any of the information, booklet, VIP access and/or other items associated with that particular course. | |
6.3 | Pole & Aerial Studio Hire: PPF Parties or Hire require a 50% non-refundable deposit of the total fee to confirm the booking, and the remaining 50% is required no later than 7 days pre-event. Strictly no refunds. Separate Contract to be completed with confirmation payment. Late Policy applies. The cancellation policy of 7 days before the hire date applies. | |
7.0 – Other Policies: | ||
7.1 | Use of your Data Policy: The General Data Protection Regulation (GDPR), is EU wide legislation, it is currently being enacted into UK law and will become the 2018 Data Protection Act. As a client of The Fitness Studios / Pole Perfect Fitness / Free Your Body Therapy, we are updating you to advise on how we will be handling your data to comply with the new General Data Protection Regulation (GDPR). | |
7.2 | CCTV Policy: Please note that CCTV is used in the public areas. All images are recorded 24 hours a day, 7 days a week, for the purpose of public safety and crime prevention. Individuals have the right to request CCTV footage of themselves; this must be in writing to the DPO as per the Data Protection Act. The fee of £10 per request is based on the administrative cost of providing the information. Information will be provided without delay and, at the latest, within one month of receipt. Please note there are some circumstances in which we can legally refuse such a claim, such as other people can be seen in the footage or the potential to put a criminal investigation at risk, etc. Photography Policy: The business reserves the right to process photographic images/videos for the ‘Legitimate Interest’ of our services. The business will notify when pictures/videos are being taken and therefore I give ‘Informed Consent’ for the business to process these as stated in our Privacy Policy. I am aware that I can ‘Opt Out’ in writing at any point stating that I do not wish to be photographed; in this case, you will be blurred or angled in such a way. | |
7.3 | Child Policies: We have a Child Protection, Anti-Bullying, and Safeguarding Policy, which can be made available on written request. | |
7.4 | Spectator Policy: We have a no-spectator in any class policy due to the nature of some classes and a safety aspect. We do not have any seating available, so it would be dangerous to sit on the floor, potentially blocking safety exits but also a hazard from a student kicking a spectator – for instance. It can also be off-putting and distracting for students to have people standing in the sidelines, so it is also for our student’s comfort. |
Nothing in these Terms & Conditions shall affect your statutory rights.

By booking your session / class you are agreeing to the above Terms & Conditions, you do so every single time you book. This is in addition to your written agreement which you sign on your 1st session with your PAR-Q.
